Gift card terms

These terms govern the purchase and use of Love in Room gift cards. They supplement the booking terms and conditions, which remain applicable to any booking paid for with a gift card.

1. Purpose and nature of the gift card

The Love in Room gift card is a digital, personal voucher issued by Love in Room, allowing all or part of a booking made on the loveinroom.fr platform to be paid for, within the limits of its balance and validity period.

The gift card is a means of payment internal to the platform. It is neither a payment instrument within the meaning of the French Monetary and Financial Code, nor electronic money, and may only be used with Love in Room.

The purchaser accepts these terms when buying. The version accepted is recorded with the card.

2. Purchase

The gift card is bought online on the platform. The purchaser chooses:

  • the amount, between €50 and €500;
  • a design;
  • where applicable, the recipient's name, the sender's name and a personal message.

Payment is made by card. The gift card is issued once payment has actually been received.

The purchaser receives by email a document containing the card code, together with a personal, secure link allowing it to be viewed again.

3. Face value

The card's face value is the amount chosen at purchase. It is expressed in euros.

The amount paid by the purchaser is credited to the card in full. Love in Room charges no issuance, management, delivery or inactivity fee.

4. Validity period

The gift card is valid for one (1) year from its purchase date. The expiry date appears on the document given to the purchaser.

After that period, the card can no longer be used and any unused balance is permanently lost, with no refund or extension, subject to mandatory legal provisions.

The card must be used before that date, that is, applied to a confirmed booking. The date of the stay may be later than the expiry date.

5. Use

The card is used by entering its code when booking on the platform.

It is applied up to the lower of its available balance and the price of the booking.

If the balance exceeds the price, the card is charged the price and keeps the remainder for later use, within its validity period. A card may therefore be used for several bookings.

The card may only be used on listings offering online booking.

6. Mixed payment

If the card balance is lower than the price of the booking, the card is applied up to its available balance and the remainder is paid by bank card, according to the payment method applicable to the booking.

Where the card covers the entire price, no card payment is requested.

7. What happens to the card on cancellation

Where a booking paid for in whole or in part with a gift card is cancelled, the refunded portion is credited back to the gift card, to the extent provided for by the applicable cancellation policy.

Crediting back does not extend the card's validity: the original expiry date remains.

The portion paid with a gift card is under no circumstances refunded in cash, by bank transfer or to a bank card.

Any portion paid by bank card is refunded to the original bank card.

8. No conversion into cash

The gift card is neither exchangeable, refundable nor convertible into cash, in whole or in part, subject to mandatory legal provisions.

No change is given.

9. Purchaser's right of withdrawal

A purchaser acting as a consumer has fourteen (14) days from receipt of the card to exercise their right of withdrawal, provided the card has not been used, even partially.

The request is made by email to [email protected], stating the purchaser's name and the date of purchase. The refund is made to the payment method used at purchase, within fourteen days of receipt of the request.

The card is then permanently deactivated.

After that period, or if the card has been used even partially, the right of withdrawal can no longer be exercised.

10. Passing the card to someone else

The gift card is intended to be given as a present. The purchaser may pass it freely to the person of their choice.

The holder of the code is deemed entitled to use it. It is for the purchaser to pass the code on securely.

11. Loss, theft and use by a third party

A gift card code must be kept confidential. Anyone who has it can use it.

Love in Room does not keep the code in clear text in its records. If the email received is lost, the purchaser may ask for the document to be sent again, to the email address used at purchase, from the personal link received or at [email protected].

Love in Room neither refunds nor replaces a card whose balance has been used by a third party, unless fraudulent use is established.

In the event of established fraud or a dispute over the purchase payment, Love in Room may block the card and suspend its use. The purchaser is notified of the block.

12. Bookings paid for with a gift card

A booking paid for with a gift card is subject to the booking terms and conditions in full, in particular as regards formation of the contract, cancellation policies, no-shows and the absence of a right of withdrawal for accommodation on a specific date.

The gift card has no effect on the price of the booking: it is applied against that price, it neither increases nor reduces it.

13. Liability

Love in Room is answerable for issuing the card, maintaining its balance and applying it correctly to a booking.

Love in Room is not liable for the purchaser passing on the code, its use by a third party to whom it was given, the availability of listings when the recipient wishes to book, or performance of the stay, which is a matter for the host.

These limitations do not apply in the event of wilful misconduct or gross negligence by Love in Room, or where a mandatory legal provision prevents it.

14. Personal data

The purchaser's data and, where applicable, the recipient's data, are processed for issuing, delivering and managing the card, and for compliance with accounting obligations.

Details are set out in our privacy policy.

15. Complaints and mediation

Any complaint concerning a gift card may be sent to [email protected].

Failing a solution, a consumer may refer the matter free of charge to the consumer mediator appointed by Love in Room, whose details appear in the legal notice.

16. Changes

Love in Room may amend these terms. The version applicable to a card is the one accepted at the time of purchase, recorded with it, and is unaffected by any later amendment.

17. Governing law

These terms are governed by French law.

Protective provisions of the law of the consumer's country of habitual residence that cannot be derogated from by agreement continue to apply.
