LoveinRoom

Terms of use

These Terms of Use (the “Terms”) govern access to and use of loveinroom.fr (the “Site”), operated by Love in Room. They apply to every visitor of the Site, whether a casual reader, partner host or simply curious. Hosts who subscribe to a paid plan are also subject to the Terms of Sale, which prevail in case of contradiction with these Terms.

1. Purpose

The Site is an editorial directory dedicated to love rooms and intimate stays in France. It lists suites, rooms and independent venues, giving visitors the information needed to choose an accommodation.

For accommodations whose host has enabled this option, Love in Room also offers an online booking service: the platform connects the guest and the host with a view to concluding, between them, a short-term rental contract, and facilitates payment for that stay via the payment provider Stripe. Love in Room then acts as a technical intermediary, with no commission on the stay when paid by bank card: it is neither the seller of the accommodation nor a payment institution. The portion of a stay paid with a Love in Room gift card carries a 10% commission. For other accommodations, the Site is limited to information and booking is made directly with the host, off-platform. Online bookings are governed by the General Booking Terms.

2. Acceptance of the Terms

By browsing the Site, users acknowledge having read these Terms and accept them for simple consultation purposes. The Terms may evolve; the version that applies is the one in force at the time of the visit.

Any binding action (creating a host account, submitting a report, posting a review when such a feature is introduced) requires the explicit acceptance of these Terms and, where applicable, of the Terms of Sale or specific conditions, via a dedicated checkbox. Such explicit acceptance has the value of a signature within the meaning of Article 1366 of the French Civil Code.

3. Access to the service

Access to the Site is free for visitors. No account is required to browse listings, regions or articles. Love in Room strives to keep the Site available 24/7, but cannot guarantee uninterrupted access: maintenance, technical issues or external factors may cause interruptions, with no liability on the publisher's side.

4. User behaviour

Users undertake to use the Site for its intended purpose. The following are notably prohibited:

  • massive content extraction (scraping, site harvesters);
  • any attempt to circumvent technical protections;
  • commercial reuse of data and content without authorisation;
  • any use of the Site for fraudulent or unlawful purposes.

Any breach may result in immediate suspension of access and, where applicable, legal action.

5. Intellectual property

The “Love in Room” brand, its logo and all graphical, editorial and software components of the Site are protected by intellectual property law. Original descriptions written by Love in Room belong to the publisher. Hosts' names, logos and photos remain the property of their respective owners and are used under the conditions specified in the Terms of Sale.

6. Origin of listings and hosts' rights

Love in Room aggregates public information about professional accommodations from sources accessible to all (official websites, public booking platforms, commercial publications). Listing an accommodation in the directory does not require the host's prior agreement.

Such listing nevertheless respects the following rights:

  • photos published on listings not yet claimed can be removed within 72 hours upon host request, with no justification required;
  • descriptions are written by our editorial team from public information, or provided by the host after claiming the listing;
  • no affiliate tracking, no hidden partnership code, no intermediary redirection on outbound links.

Any host may claim their listing through the verification flow, after identity verification via email on the establishment's domain or any equivalent official document (Kbis extract, SIRENE notice, beneficial ownership register). They may also request the plain and simple removal of their listing. Removal is processed within 72 hours maximum, with no justification required. The licence terms applicable to subscribed hosts are detailed in the Terms of Sale.

7. Use of artificial intelligence

7.1 Listing descriptions

Part of the descriptions displayed on listings not yet claimed is generated automatically by an artificial intelligence model, from public information related to the accommodation. The model used is designed and operated by a third-party provider (Anthropic).

Each generated description is reviewed and approved by a Love in Room team member before publication. No third-party description is reused verbatim.

Hosts who claim their listing can replace this description with their own at any time from the partner area.

7.2 Promotional videos and visuals

Love in Room publishes promotional content for the accommodations listed in the directory on its social media accounts: photo edits, short videos and animated slideshows, built from the listing's own material. They are produced using creative assistance tools, some of which rely on artificial intelligence: editing, animation, subtitling, synthetic voice-over and, where applicable, the generation of shots. Not all of these publications are therefore generated by artificial intelligence, and those that do rely on it do not all do so to the same extent.

Where a publication includes images generated by artificial intelligence, or a representation of the accommodation substantially altered by such tools, it carries a visible statement to that effect, in accordance with article 50 of Regulation (EU) 2024/1689 on artificial intelligence, together with the equivalent disclosures provided by the distribution platforms.

This content is illustrative and promotional. It does not replace the information on the listing, which alone is authoritative as to the characteristics of the accommodation, and it may never show spaces, amenities or services that do not exist. Only listings claimed by a host holding an account are concerned; the terms applicable to that host, including their right to object, are set out in article 12 of the Terms of Sale.

Any inaccuracy noticed in one of these publications may be reported to [email protected]: the content is then corrected or taken down without delay.

7.3 No automated decision-making

In application of the European regulation on artificial intelligence, these uses remain limited to the production of non-decisional editorial content. They are not used to automate any decision producing a legal effect on individuals.

8. Ranking criteria and paid placements

In accordance with Article L. 111-7 of the French Consumer Code, Love in Room transparently communicates the criteria used to rank listings on the directory:

  • default organic criteria: editorial relevance, listing completeness (description, photos, declared amenities), geographical proximity to the search query, freshness of information;
  • paid placements: certain surfaces of the Site (homepage, category pages, regions, departments, cities) feature a limited number of premium slots offered to partner hosts who have subscribed to a quarterly featured placement. In search results, these slots are flagged visually with a “Recommended” tag on the relevant listing; on the homepage, the “Featured” grid is presented as a curated selection, with no display distinction between subscribed placements and the others;
  • a paid placement does not alter the listing's content nor any associated reviews; it only changes its display position on the relevant surface.

The financial and operational terms of paid placements are detailed in the Terms of Sale and on the /tarifs page.

9. Editorial moderation and unlawful content reporting

In accordance with Articles 14, 16, 17 and 20 of Regulation (EU) 2022/2065 on digital services (DSA), Love in Room implements a structured mechanism for the reporting and handling of unlawful content present on the Site (listings, descriptions, photos, links, future reviews).

How to report content: any report can be sent to [email protected], specifying:

  • the exact URL of the content concerned;
  • the alleged nature of the unlawful character (copyright infringement, image rights, defamation, misleading content, counterfeiting, child sexual abuse material, hate speech, etc.);
  • a substantiated explanation of the report;
  • the identity and contact details of the notifier (except for legally anonymous reports);
  • a good-faith statement as to the accuracy of the elements provided.

Processing: any report receives an automatic acknowledgement of receipt. Manifestly unlawful content is reviewed and, where applicable, removed within 24 to 48 working hours. Complex reports undergo a thorough human review within a reasonable time. Any decision (removal, retention, suspension of the host account) is reasoned and communicated to the author of the content and to the notifier where legally possible (Article 17 DSA).

Internal appeal: the author of any content removed or suspended has thirty (30) days to challenge the decision by writing to [email protected]. This appeal route is free of charge and human review is guaranteed, in accordance with Article 20 of the DSA.

Competent authorities: in case of criminally reprehensible content, users may also notify French authorities via the PHAROS platform (internet-signalement.gouv.fr) or the Signal-Spam service for abusive electronic communications.

10. LCEN status as publisher and host

Within the meaning of the French Act for confidence in the digital economy (LCEN), Love in Room acts:

  • as a publisher for content produced internally (auto-generated descriptions reviewed by the team, blog articles, editorial pages, comparisons, guides);
  • as a host within the meaning of Article 6-I-2 of the LCEN for content provided by partner hosts (descriptions written by the host, official photos submitted after claiming, future reviews).

This distinction entails different liability regimes: Love in Room is directly responsible for the content it publishes as an editor, but its host liability is only engaged if it has not acted promptly to remove unlawful content after having effective knowledge of its unlawful nature (duly formed notification).

11. Cookies and personal data

Love in Room has chosen a minimalist, privacy-respectful audience measurement policy. The analytics tool used (Umami, self-hosted) does not collect any tracking cookie, advertising identifier or data enabling cross-site tracking. As such, and in accordance with CNIL deliberation no. 2020-091, its use is exempt from prior user consent. This is why no cookie banner is displayed when visiting the Site.

Details of the technical cookies necessary for the proper operation of the Site are set out in the cookies policy. The processing of personal data, its purposes, retention periods and the rights of any data subject are described in the privacy policy.

Any request relating to the exercise of GDPR rights (access, rectification, erasure, portability, objection, restriction) can be sent to [email protected].

12. External links

The Site contains links to third-party websites (hosts' official websites, booking platforms, institutional resources). These sites are independent of Love in Room; their content and practices are not our responsibility. In line with our transparency commitment, no outbound link contains affiliate tracking or hidden partnership codes.

13. Limitation of liability

Love in Room undertakes a best-effort obligation, and not an obligation of result, in the provision of the service. The publisher deploys its best efforts to keep the Site available 24 hours a day, without committing to a contractual service level (SLA).

Information published (rates, amenities, availability) is provided for guidance only. Before booking, users are invited to verify terms directly with the host. Love in Room cannot be held liable for:

  • a temporary unavailability of the Site related to maintenance, a technical incident or an external factor;
  • a unilateral change made by a host to their rates, availability or stay conditions;
  • a dispute arising between a host and a traveller during a booking made outside the Site;
  • the content, availability or practices of third-party websites accessible via external links;
  • indirect damages (loss of profits, loss of earnings, loss of clientele), loss of chance, loss or alteration of data, and damage to reputation, except for mandatory provisions to the contrary.

These limitations do not apply in case of gross negligence, wilful misconduct or bodily harm, in accordance with the mandatory provisions of French law.

14. Service changes and discontinuation

Love in Room may evolve, suspend or remove a feature of the Site as part of continuous improvement. Major changes are communicated through the usual channels (newsletter, blog posts).

In case of total and definitive discontinuation of the service, Love in Room undertakes to inform affected users and partner hosts at least thirty (30) days before the effective cessation, and to retain the data necessary for legal obligations (invoicing, audit, litigation) for the durations set out in the privacy policy.

15. Minors

Access to content: the Site is not intended for minors. The accommodations listed are private rooms and suites for adult use (stays for two). Visitors are presumed to be at least eighteen (18) years old, or to have the consent of their legal representative to consult the content.

Personal data of a minor: in accordance with Article 8 GDPR and Article 45 of French Act no. 78-17 as amended, consent to the processing of personal data is validly given only from the age of fifteen (15). Below this age, consent must be given jointly by the minor and the holder of parental authority. No personal data of a minor is knowingly collected by Love in Room.

If a parent or legal guardian notices that data concerning a minor under 15 has been recorded, they may request its immediate deletion at [email protected].

17. Governing law and jurisdiction

These Terms are governed by French law, excluding its conflict-of-laws rules.

In case of dispute, and after an attempt at amicable resolution, the French courts shall have jurisdiction. Users acting as consumers may, at their choice, refer the matter to one of the courts territorially competent under the French Code of Civil Procedure, or to the court of the place where they were domiciled at the time of the conclusion of the contract or the occurrence of the harmful event, in accordance with Article R. 631-3 of the French Consumer Code.
