In force for any booking made through Love in Room. Guests acting as consumers retain the benefit of the mandatory protective provisions of the French Consumer Code.
1. Purpose and role of Love in Room
These General Booking Terms (“GBT”) govern any accommodation booking made by a guest through the Love in Room platform. They complement the Terms of Service and the privacy policy, and prevail over them for anything relating to the booking.
A booking forms a short-term rental contract entered into directly between the guest and the host. Love in Room is not a party to that contract: the platform acts solely as a technical intermediary for matchmaking and payment facilitation, with no commission on the stay when paid by bank card. Sole exception: the portion of a stay paid with a Love in Room gift card carries a 10% commission, which remunerates the sale of the card; the balance is paid to the host. Love in Room does not sell the accommodation and does not guarantee the host’s service. Funds are collected by the payment provider Stripe (see article 5); Love in Room is not a payment institution.
A booking requires the guest’s express acceptance of these GBT, collected via a timestamped checkbox at the time of payment. The accepted version is retained as proof.
2. Guest commitments
- provide accurate information (identity, contact details) when booking;
- pay the full amount agreed and locked at the time of booking;
- read and accept the cancellation policy shown on the listing before booking;
- comply with the property’s rules (capacity, pets, smoking) stated on the listing;
- notify the host at least 24h before check-in in case of delay or impediment;
- be at least 18 years old on the date of the stay.
3. Host commitments
- provide accommodation that matches the published listing (photos, amenities, capacity);
- respond to a booking request within 24h, failing which the request is automatically declined and the card hold released;
- keep their calendar availability up to date;
- ensure a proper welcome on the arrival day (key handover, access instructions).
4. Booking process
Bookings are made on request: at payment, a card hold (authorization, with no immediate charge) is placed on the guest's card and the request is sent to the host. The host has 24 hours to accept it — the guest is then charged and the booking confirmed — or to decline it, in which case the hold is released with no charge. Without a response within 24 hours, the request is automatically declined and the hold released. The applicable price is the one displayed and locked at the time of booking; it is not affected by any subsequent price changes. The essential characteristics of the accommodation and the identity of the host (the seller) are shown on the listing before booking.
5. Payment, price and fees
Payment is made exclusively online, at the time of booking, via the provider Stripe — a licensed payment institution that collects and holds the funds, then transfers them to the host about 24h after the start of the stay. The amount shown is the total, all taxes included: no service fee is added to the guest and bank fees are never passed on to them. Love in Room stores no banking data. Where applicable, the tourist tax is collected by the host; it may be included in the displayed price or charged on site, as indicated on the listing.
6. Cancellation and refund
The following cancellation policy applies to any online booking:
A single cancellation policy applies to all bookings: full refund (100%) for any cancellation made more than 48 hours before arrival; 75% refund for a cancellation made less than 48 hours before arrival; no refund in the event of a no-show. If the host cancels or in the event of a proven dispute, the guest is refunded up to 100%.
Non-refundable payment processing fees. In the event of cancellation, regardless of the applicable refund tier, the payment processing fees incurred at the time of payment (and not returned by our payment provider) are retained by the platform. The refund is therefore capped at the amount paid, less those fees.
7. Right of withdrawal
As accommodation provided on a specific date or period, a booking does not give rise to the fourteen-day withdrawal period applicable to distance contracts (article L. 221-28, 12° of the French Consumer Code). Only the cancellation schedules set out in article 6 apply.
8. Deposit / security deposit
Love in Room manages no deposit or security deposit. If the host requires one, it is agreed, collected and returned directly between the host and the guest, outside the platform. Love in Room is not involved in its handling and disclaims any liability in this respect.
9. Disputes, customer service and mediation
In case of difficulty relating to the service (non-compliant accommodation, unreachable host…), the guest should first contact the Love in Room team, which may suspend the transfer of funds to the host and seek an amicable solution.
Any refund granted by customer service is a mediation facility, not an automatic assumption by Love in Room of a dispute that falls to the host. In accordance with articles L. 616-1 and R. 616-1 of the French Consumer Code, the guest may use, free of charge, the consumer mediator designated by Love in Room: CM2C — Centre de la Médiation de la Consommation de Conciliateurs de Justice, 49 rue de Ponthieu, 75008 Paris, France — [email protected] — cm2c.net/declarer-un-litige.php. Referral requires a prior written complaint that has not received a satisfactory response (Article L. 612-2 of the French Consumer Code). A European online dispute resolution platform is also available: ec.europa.eu/consumers/odr.
10. Responsibilities
Each party answers for its own role:
- The host is solely responsible for the service it sells (compliance of the property with the listing, cleanliness, safety, welcome) and indemnifies Love in Room against any claim relating to that service;
- The guest answers for compliance with the property’s rules and the consequences of a no-show, a late cancellation or damage;
- Love in Room is responsible only for its own service (reasonable availability of the booking flow, correct execution of the payment operations it orchestrates, data processing) and does not guarantee the proper performance of the stay; the payment service itself is provided by Stripe.
11. Personal data
Booking is done without account creation (“guest checkout”): the guest accesses their booking via a personal link received by email (“magic link”). The data collected (identity, contact details, IP address, proof of acceptance of these GBT, stay history) is processed in accordance with our privacy policy and kept for thirteen months after the stay, unless a longer legal retention applies.
12. Governing law and jurisdiction
These GBT are governed by French law. After an attempt at amicable resolution, the French courts have jurisdiction, the guest acting as a consumer retaining the benefit of the protective rules of the French Consumer Code.
