These Terms of Sale (the “Terms”) govern (i) the subscription to a Love in Room plan by a professional host and (ii) the purchase of Love in Room gift cards (section 16 bis), the only purchase a visitor may make from Love in Room. Otherwise, visitors of the Site do not purchase anything from Love in Room and are governed by the Terms of Use.
1. Pre-contractual information
Prior to subscribing, hosts have access to the following information:
- identity of the seller: Nicolas Lipowiez, sole proprietorship (French entreprise individuelle, micro-entrepreneur scheme), SIRET 803 893 809 00043, whose full contact details are listed in the legal notices;
- essential characteristics of the service: editorial directory of love rooms in France, monthly or yearly subscription, access to a partner area, email support, optional featured placements;
- price: see the “Pricing and VAT” section below and the /tarifs page;
- delivery terms: subscription immediately active after the trial, access to the partner area without delay after account creation;
- existence and conditions of the right of withdrawal: see the dedicated section below;
- identity and contact details of after-sales service: [email protected].
2. Purpose
Love in Room offers hosts a subscription that lets them publish listings on the editorial directory loveinroom.fr. The subscription gives access to a partner dashboard, listing management tools and, optionally, featured placements.
3. Intermediation status
Love in Room is a directory and intermediation service within the meaning of Article 6-I-2 of the LCEN. Love in Room is neither the owner, operator, nor agent of the listed accommodations, and collects no commission on bookings concluded between travellers and hosts and paid by bank card. Sole exception: the portion of a stay paid with a Love in Room gift card carries a 10% commission, which remunerates the sale of the card; the balance is paid to the host.
Where the host enables online booking, Love in Room also acts as a platform operator that facilitates payment for the stay. The traveller’s funds are collected, held and then transferred to the host by the payment provider Stripe (a licensed payment institution); they do not pass through Love in Room’s accounts and do not constitute its turnover. Love in Room remains a technical intermediary and is not a payment institution. The relationship between the traveller and the host for a booking is governed by the General Booking Terms.
The host concludes the rental contract directly with the traveller, under their own responsibility, in compliance with the rules applicable to their activity (short-term rental, furnished tourism rental, hotel business, etc.). Love in Room cannot be held jointly liable for the services provided by the host or for the contractual relationship between the host and the traveller.
4. Definition of services
Unless stated otherwise, a subscription includes:
- publication of the detailed listings included with the subscribed plan (two on Standard, no limit on Premium);
- access to the partner area (editing, analytics, support);
- the ability to add extra listings at a fixed unit price;
- the option to subscribe to featured placements (homepage, category, region, department, city).
5. Pricing and VAT
The Freemium plan is free. Paid plans (Standard, Premium) are billed between €14.90 and €19.90 per month depending on the chosen tier and the formula (monthly or yearly). Beyond the listings included with the plan, each additional listing is billed €1.99 per month. Featured placements are billed quarterly. Current pricing is available on the /tarifs page.
Temporary promotional offers (for example a launch discount reserved for new partners) may apply from time to time. Their exact terms — amount, duration and eligibility — are shown at the time of subscription and, where applicable, on the /tarifs page. Once the promotional period ends, the regular price then in force applies.
Prices are quoted in euros. Love in Room operates under the small business VAT exemption regime (Article 293 B of the French General Tax Code): no VAT is charged or collected, and the displayed amount is the amount actually debited. Should this regime cease to apply, or under reverse-charge rules for taxable hosts established outside France, the applicable value added tax would be shown on invoices and any pricing change notified under the conditions set out below.
Any pricing change is notified to the host by email at least 30 days before it takes effect. The host is entitled to terminate the subscription free of charge during this notice period. Failing termination, the new pricing applies at the next renewal date.
6. Payment terms
Payment is made by card via our processor Stripe (Stripe Payments Europe Ltd, licensed payment institution). No card details are stored by Love in Room. Stripe is PCI-DSS Level 1 certified; card data is transmitted directly to Stripe in a secure environment.
The payment method is retained by Stripe in tokenised form, in order to process the successive charges related to the renewal of the subscription. Subprocessing by Stripe is governed by a GDPR-compliant data processing agreement. The full list of technical subprocessors is available in the privacy policy.
A failed charge triggers the procedure set out in the “Service suspension” section, without prejudice to the late payment penalties and the fixed recovery fee defined further below.
7. Free trial
A 30-day free trial is offered for any first subscription. A valid payment card is required at sign-up to activate the trial, but no amount is charged during those 30 days. At the end of the trial, the subscription automatically rolls over to a paid plan, unless cancelled beforehand from the partner area.
8. Invoicing
Invoices are issued and stored by Stripe on behalf of Love in Room. They can be downloaded from the partner area and are retained for the legal duration of ten (10) years, in accordance with Article L. 123-22 of the French Commercial Code.
9. Automatic renewal
The subscription renews automatically at each term (monthly or yearly). Hosts can cancel renewal at any time; the subscription remains active until the end of the current period.
10. Host obligations and warranties
By subscribing, the host represents and warrants that they:
- comply with all administrative, tax and regulatory obligations applicable to their activity (town hall declaration for furnished tourism rentals, registration with the beneficial ownership register where applicable, condominium authorisation if required, collection and remittance of the tourist tax, classification where relevant);
- publish accurate, up-to-date and non-misleading information on the listing, and report to Love in Room any substantial change (capacity, amenities, indicative price, address, temporary or permanent closure);
- hold all intellectual property rights and image rights attached to the content (photographs, descriptions, videos, logos) they publish or provide, or hold the necessary authorisations from their rights holders;
- have subscribed to, and maintain throughout the subscription, professional civil liability insurance covering their accommodation activity, including damages that may be caused to travellers, including for stays booked online via the platform;
- do not include in the listing's content or in communications with travellers any commercial link, affiliate code, promotional tracking parameter or redirection to a third-party platform, in line with Love in Room's editorial ethics;
- do not publish unlawful, defamatory, misleading, infringing or indecent content, and cooperate in good faith with any takedown request issued by Love in Room following a third-party report;
- respond within reasonable timeframes to traveller enquiries and honour confirmed bookings;
- if they enable online booking: be the sole seller of and party responsible for the rental contract with the traveller, provide a service that matches the listing, maintain a valid Stripe Connect account to receive transfers, comply with the platform's single cancellation policy, and handle any deposit directly with the traveller, off-platform, Love in Room being neither a party to the rental contract nor a guarantor of the service.
The host indemnifies and holds Love in Room harmless against any recourse, action, complaint or claim brought by a third party (traveller, photographic or intellectual rights holder, co-owner, public authority) in connection with the content of the listing, the operation of the accommodation, the service provided to the traveller in connection with a booking made via the platform, or the host's failure to comply with a legal obligation. This warranty includes reasonable defence costs, indemnities, damages and interest borne by Love in Room.
11. Editorial moderation and Love in Room's rights
Love in Room is responsible for the editorial quality of its directory. As such, Love in Room reserves, at any time and without compensation due to the host:
- the right to refuse or suspend the publication of a listing in case of inconsistency, manifestly erroneous information or non-compliance with these Terms;
- the right to make minor editorial corrections (spelling, grammar, punctuation, photograph cropping) without altering the meaning or the substantial elements of the content;
- the right to rank, classify and present listings according to editorial, relevance or paid placement criteria, in accordance with Article L. 111-7 of the French Consumer Code;
- the right to ban the host in case of serious breach (fraud, unlawful content, circumvention of the affiliation ban, repeated verified traveller complaints), without refund of amounts already paid and without prejudice to the host's liability.
Any suspension or ban decision is reasoned and notified to the host by email, in accordance with Article 14 of Regulation (EU) 2022/2065 (DSA). The host has thirty (30) days to challenge the decision by writing to [email protected]; this internal appeal channel is free of charge and human review is guaranteed.
12. Licence to use the host's content
The host retains full intellectual property over the content they publish on the listing (photographs, descriptions, videos, logos). By creating an account and publishing a listing — whichever plan is chosen, including the free Freemium plan — they grant Love in Room, for the entire time the listing remains published and for the thirty (30) days following its unpublication or the termination of the subscription, a non-exclusive, royalty-free, worldwide licence allowing Love in Room to:
- display and reproduce this content on the Site and its sub-domains;
- use it in Love in Room's editorial and marketing communications (newsletters, social media, press materials, OG images, possible mobile applications) directly related to the promotion of the directory or the relevant listing;
- carry out the necessary technical adaptations (resizing, compression, format conversion, thumbnail generation, web optimisation);
- produce the derivative promotional content described in article 12.1 below.
12.1 Derivative promotional content and use of artificial intelligence
Love in Room produces and publishes, on its own social media accounts and on the Site, promotional content for the accommodations listed in the directory: photo edits, short videos and animated slideshows. This content is built from the listing's own material (photographs, description, trade name, city, amenities, indicative price), and the licence above expressly includes, for that purpose, the right to reproduce, adapt, edit and animate it.
It is produced using creative assistance tools, some of which rely on artificial intelligence: editing, animation, retouching, subtitling, synthetic voice-over, background audio and, where applicable, the generation of shots. Those tools are operated by third-party providers, whose selection may change over time. How far they are involved varies from one publication to another: some are no more than an edit of the photographs supplied by the host, others include generated or animated sequences.
Where a publication includes images generated by artificial intelligence, or a representation of the accommodation substantially altered by such tools, Love in Room states this visibly on the publication itself and fills in the equivalent disclosures provided by the distribution platforms, in accordance with article 50 of Regulation (EU) 2024/1689 on artificial intelligence.
Whichever tools are used, Love in Room undertakes to:
- give no misleading representation of the accommodation: the video may not suggest spaces, amenities, dimensions, views or services that do not exist;
- show no identifiable individual who does not already appear in the photographs supplied by the host;
- correct or take down without delay any publication the host reports as inaccurate.
This content is produced at Love in Room's initiative and expense and gives rise to no payment to the host, who benefits in return from the visibility given to their establishment. The host remains liable, under article 10, for holding the rights attached to the content they supply, including image rights clearances for any individual appearing in it.
Listings that have not yet been claimed by their host fall outside this arrangement: no derivative promotional content is produced from a listing for as long as no host account is attached to it.
12.2 Objection
The host may object at any time to the production of new promotional content concerning them, without having to give reasons, free of charge and with no effect on their subscription, by simply emailing [email protected]. Love in Room stops any further production within seven (7) days of receiving the request.
12.3 Content after termination
Upon expiry of the thirty (30) day period referred to above, Love in Room ceases all public distribution of the content on the Site, subject to technical copies (backups, archives, application logs) and anonymised statistics that may be retained for the durations set out in the privacy policy.
Promotional content already published on social media before the termination or the objection remains online: those platforms make it impossible to guarantee its complete removal, in particular where it has been shared, re-posted or copied by third parties. Love in Room will however remove, at the host's request and within thirty (30) days, the publications that remain under its direct control on its own accounts.
13. Modification of the Terms and contractual hierarchy
Love in Room may amend these Terms. Any substantial change (pricing, termination conditions, scope of service) is notified to the host by email at least 30 days before it takes effect.
The host is entitled to terminate the subscription free of charge during this notice period. Failing termination, the new Terms apply at the next renewal date.
Minor changes (wording correction, link update, editorial precision) take effect immediately and are flagged by the page's update date.
In case of contradiction between these Terms and any specific conditions (Verified Host and Super Host programmes, special partnerships) accepted by the host, the specific conditions prevail. These Terms prevail over the Terms of Use applicable to visitors.
14. Termination
Termination is done in one click from the partner area. It takes effect at the end of the current period, with no penalty or hidden fees. No prorata refund applies for an ongoing period, except in cases provided for by applicable law, in particular for hosts acting as consumers within the meaning of Article L. 215-1 of the French Consumer Code.
15. Listing lifecycle after termination
After termination, the listing is unpublished from the Site within 72 hours maximum. To preserve search engine quality and user experience, the listing's canonical URL may be retained and redirected:
- via HTTP 301 redirect to a relevant parent page (city, department, category) if the accommodation still exists but leaves the platform;
- via HTTP 410 (Gone) response in case of permanent closure of the establishment or express request from the host based on Article 17 GDPR.
The host's personal data is deleted or anonymised in accordance with the privacy policy, subject to legal retention obligations (invoicing, audit, litigation).
16. Right of withdrawal
Pursuant to Article L. 221-3 of the French Consumer Code, the right of withdrawal for distance contracts does not apply to contracts between professionals. However, if the host acts as a consumer (e.g. unregistered private owner), they benefit from a 14-day withdrawal period from subscription. The request can be sent to [email protected].
16 bis. Sale of gift cards (consumer customers)
This section governs the purchase of Love in Room gift cards by any customer, whether a professional or a consumer. A gift card is a prepaid voucher issued by Nicolas Lipowiez, sole proprietorship (SIRET 803 893 809 00043), usable solely to pay all or part of an accommodation booking on loveinroom.fr.
- Purchase and delivery. The amount is chosen by the buyer between the displayed minimum and maximum. Payment is due immediately (bank card, 3-D Secure strong authentication). After payment, the card is delivered to the buyer by email as a PDF file containing a unique code. Any service fees are shown before payment.
- Bearer code. The card code is a bearer instrument: anyone holding it may use it. The buyer undertakes to share it only with its intended beneficiary and to keep it confidential. Love in Room never stores the code in clear text and cannot be held liable for use by a third party who obtained the code. If lost, a code regeneration may be requested from customer support.
- Validity. The card is valid for twelve (12) months from the purchase date. This period is brought to the buyer's attention before payment and stated on the card. On expiry, any unused balance ceases to be usable and remains acquired by the issuer, within the limits permitted by law.
- Single use. The card is used once, for a single booking. If the booking amount exceeds the card balance, the difference is paid by bank card. If it is lower, the remainder is neither refunded, carried over, nor split across bookings: it remains acquired by the issuer, within the limits permitted by law. This is brought to the buyer's attention before payment.
- Non-reloadable and not convertible into cash. The card cannot be reloaded or exchanged for cash, in whole or in part, except where the right of withdrawal below is exercised.
- Disputed or unpaid payment. If the payment used to purchase the card is disputed, cancelled, rejected or remains unpaid, Love in Room may suspend or cancel the card, together with any booking paid using it, without compensation.
- Personal use. The card is intended for personal use or to be given as a gift. Its resale, exchange for value or auction, in particular on third-party platforms, is prohibited and may result in its cancellation.
- Booking cancellation. Where a booking paid in whole or in part with a gift card is cancelled and gives rise to a refund, the portion funded by the card is credited back to the card (and becomes usable again until its expiry date), not refunded in cash. Any portion paid by bank card is refunded according to the cancellation policy applicable to the booking.
- Right of withdrawal. Pursuant to Articles L. 221-18 et seq. of the French Consumer Code, the consumer has a fourteen (14) day period to withdraw from the purchase of an unused gift card, by request to [email protected]. This right is extinguished once the card has been used, in whole or in part, to pay for a booking, performance having then begun at the beneficiary's request.
- VAT. VAT not applicable, Article 293 B of the French Tax Code (issuer under the basic exemption scheme).
17. Consumer mediation
Where the host acts as a consumer within the meaning of the introductory article of the French Consumer Code, they may, in accordance with Articles L. 616-1 and R. 616-1 of said code, free of charge refer the matter to the consumer mediator appointed by Love in Room:

Referral to the mediator requires a prior written complaint to Love in Room that has not received a satisfactory response (Article L. 612-2 of the French Consumer Code).

18. Limitation of liability
The liability of Love in Room, on account of the performance or non-performance of the contract, is limited to the total amount actually paid by the host over the twelve (12) months preceding the event giving rise to the claim.
The following are expressly excluded from any compensation, except as required by mandatory provisions of law:
- indirect damages (loss of profits, loss of earnings, loss of clientele, loss of business opportunities);
- loss of chance;
- loss or alteration of data;
- damage to reputation or brand image.
This limitation and these exclusions do not apply in case of gross negligence, wilful misconduct or bodily harm, in accordance with the mandatory provisions of French law.
Love in Room does not guarantee any volume of visitors, number of bookings or revenue level for the host. The subscription constitutes a best-effort obligation, not an obligation of result.
19. Force majeure
Neither party can be held liable for a failure to perform its contractual obligations if such failure results from a force majeure event within the meaning of Article 1218 of the French Civil Code, that is, an event beyond the reasonable control of the party invoking it, that could not reasonably be foreseen at the conclusion of the contract and whose effects cannot be avoided by appropriate measures.
The following events are notably considered force majeure: total cessation of activity of a critical technical subprocessor (hosting, payment) without a fallback solution within thirty (30) days, an administrative or judicial decision imposing the cessation of the service, a characterised large-scale cyber attack, armed conflict, pandemic recognised by health authorities.
The party prevented notifies the other party by any written means within a reasonable time. If the situation persists for more than sixty (60) days, either party may terminate the contract without penalty.
20. Service suspension
If a payment fails, the host receives a reminder email. If the situation is not resolved within 7 days, the listing is hidden from the Site until payment is regularised. The account remains accessible so the payment method can be updated.
21. Late payment penalties and fixed recovery fee
Pursuant to Article L. 441-10 of the French Commercial Code, any late payment between professionals gives rise, by operation of law and without a prior notice being required, to interest calculated at the European Central Bank's main refinancing rate plus ten percentage points.
A fixed recovery fee of forty euros (€40) per unpaid invoice also applies.
These penalties are added, where applicable, to the consequences described in the previous section (“Service suspension”).
22. Governing law and disputes
These Terms are governed by French law, excluding its conflict-of-laws rules.
In case of dispute, parties agree to seek an amicable solution. Failing an agreement within a reasonable time, and subject to the provisions of Article 17 on consumer mediation, the dispute shall fall under the exclusive jurisdiction of the Commercial Court of Paris, unless a mandatory rule states otherwise.
